The problem with your scenario would be Lids can't use the exact font because they would be selling it to you and profiting. You could always do it in the closest stock font they have available and there would be no problem, they own the patent on the font, not the # 15 or the name Schatz. And I agree, I don't think there going to come hunt you down for your 1 hat. But if you pull up to the Nationals with a trailer full and start selling them, I'd say it will be game on.

Alright I figured out the SCHATZ font now just trying to figure out the 15..anyhelp we be cool. doenst have to be exact.

A font is a set of printable or displayable text character s in a specific style and size. The type design for a set of fonts is the typeface and variations of this design form the typeface family .

Exactly right.   You can get close enough to the original and have one made for yourself and never need to worry about Schatz or Tony Stewart Racing coming after you.    You could even take your knock off item right up to Shatz and he will sign it and not say a word.   If you decide to duplicate your knock off item to sell for profit then it won't be long before Tony Stewart Racing will ruin your day by bringing the local sheriff to your selling location to help confiscate your knock off inventory and shut you down.   You'll actually be lucky if it ended there as they can/will also serve you with lawsuit papers and you'll then be forced to hire a lawyer to negotiate a money settlement to make the lawsuit go away.

They have no choice but to protect their car number font and signature.   If they didn't they would have a parking lot full of vendors selling boot leg items for half the price at every race they went to.   Thats just the way it is.

Really !!! ... 2 pages on the legality of making One hat or 5 hats for your family....

I think Stewart has had enough " publicity " lately to last a life time , that a news article in the New York Times on how he went after a " fan " for making a hat  " to show is support of his favorite driver " is not gonna be on his radar....And if it is he should fire his PR people ASAP !...... LOL

 

So, let's say there are 500 different font's available to the graphics industry, If i'm understanding some of you on here,  that if 500 people would patent each font the rest of us are screwed... We wouldn't be able to put a number on anything because we would be infringing on someone ?

This is ridiculous......

You CANNOT copyright, nor trade mark a 'font' or an actual 'type set'. UNLESS it is done so by the company that created it or has paid the money to have it created soley for their use.

You CAN copyright and / or trademark a given word (or name or number) in a particular typeset or font, HOWEVER, as someone else noted on here, if you change it (virtually) at all, it is no longer the 'same' as said TM'd or copyrighted word/number.

So, TSR can cr or tm "Schatz" or his #15 as on the car or their hauler or merchandize, but any VARIATION (different name or number in the same typeset or font) you're in the clear, provided it's not a font that was created and owned by them or their designer (YAK, in this case).

Ask 'Dad' Braishers family.  He designed the G for the Packers, so that fits right in with what you are saying.  Thanks for that.
