After reading about the suspension of Jeremy Clements from Nascar due to racial slurs, I once again noticed an onslaught of responses claiming that our 1st amendment rights are being threatened again. And, since I don't belong to any Nascar forums, this is where we can maybe clear it up:

NO, NONE, NADA private business or organization has to abide by the 1st amendment. Never has, never will. He was not arrested. He was not given a trial date. He was not publicly executed. He was suspended by a sanctioning body for conduct that does not reflect well on the sanctioning body. Period. Nascar and any other private business or organization reserves the right to do so. If one of my employees comes in to work and calls me an a$$hole, I am going to fire him. I give two $hits about his freedom of speech.

Give it a rest already.

Good point. The 1st amendment just protects American citizens from any unlawful arrests for anything that they say as well as religion. It does not protect an employee from making statements about his beliefs from being terminated or suspended from that said job. If I were at my job and said a bunch of racial slurs to anyone I would be subject to dismissal and I understand that. The 1st Amendment was put into place because under the old English law or Monarchy, anyone stating displeasure with the King would be subject to treason and execution. We have freedom from being able to say whatever we want to say and not be arrested.

I agree 100% with you egras, Nascar is no different than someones personal business and the drivers are the employees and are held accountable for the things they say and do.

I didn't really know anything about this until I read your post so I googled it and read a couple articles about it, it seems pretty weird in the way he said it to a reporter but it doesn't sound like it went any further than that, so actually the public doesn't even know what he said, there just saying it was racial, their not even saying if it was pre or post race. Seems abit like a pretty stiff penalty for something that was said that didn't even make it to the mainstream, we probably wouldn't even know about it if it wasn't for the suspension, makes you wonder if there is more to the story, like he's gotten previous warnings or something.

Reminds me of "If a tree falls in a forest and no one is around to hear it, does it make a sound?"

Maybe he called Tony Doughnut boy! Smile

Yeah, I agree. I was just pointing out that it has nothing to do with the 1st amendment. Anyone with a microphone in their face has to really watch what they say anymore.

I'd say they need to unionize. As long as you do your job you can pretty much tell anybody what you think of them without penalty. Or if they fire you, you can file a grievance and get your job back. lol
My wife told me if I went to one more Sprint Car race 
she would leave me.................I'm sure gonna miss 
that ol' gal.

A union would make no difference in this situation, he violated a code of conduct, Major sports like the NFL, the players have a union and they still have a code of conduct from the organization and if they don't abide by it they are fined and suspended. look up Brandon Jacobs suspension from the 49ers at the end of this year, he was suspended for 3 games for tweets complaining that he wasn't getting playing time.

I'm not really sure what unions have to do with this though

I found it interesting that the remarks came during an interview with a reporter from MTV.

MTV has reporters? At a NASCAR race??

Sounds like a Walmart boy there. There should never be decent wages, benefits, and job security. To hell with all that stuff. How's a company supposed to make a profit? It was originally posted tongue in cheek, hence the lol afterwards.

The funny thing is...Nascar brought way more attention the the matter with the suspension....had they not done it....we prob never hear about it....

I would think that the biggest misconception here is that the drivers are "Employees" I do not believe that to be the case. The drivers are independent contractors so to speak, they are not paid wages by NASCAR, and they would only be considered to be employees of the car owner with whom they are signed.

But I feel NASCAR was justified in reeling this driver in here, there is no place for that kind of language in the realm of good sportsmanship.

Now as for NASCAR and the remarks being detrimental to the sport, that is very laughable. NASCAR has made their Sprint Cup Series a joke when it comes to calling it a RACE, it is just an entertainment show, and a very poor one at that! They have destroyed the sport part of racing.

This happened while I was in basic training in 1982 while in classroom & this is his actual words & the guy was a black instructor, Why is it if a white person calls us a nigger we will want to beat there ass but if a nigger calls another black person a nigger it's all right ???

It is perfectly acceptable for blacks to refer to one another in that manner.

However, if another race (any other color) refers to them that way then they consider it racist.

Last I checked you don't get arrested for using that word, go ahead and use it all you'd like, in fact you should work it into every sentence. Legally your free to use it, its socially you may run into issues.

Mainly if I was you I would use it at work alot, like around your boss and customers and then if someone gets mad give them your explanation you just gave here, I'm sure you will convince them too!

I'm fully aware of that. I've worked with black people that were welcome in my home anytime & then I've worked at some places that have (black) temps that that talk shit & don't care who hears them that are your typical whatever you want to call them & then they want to know why they are stereotyped. I have neighbors that I have lived around for years that are just as nice as can be. About 8 mos ago there were some moved in down the street that when you go by when it's nice out with there damn car door open & look at you like you are in the wrong when you go by. I'm civil as long as you are civil to me. If not I just won't have nothing to do with ya. There are many on here that know me and can attest to what I'm like. Personally I still don't like the way things are in the world today & it's only going to get worse but I'll live my life until I can't work or do the other things I like to do.

Never heard of Jeremy Clements must be a new guy and for him to want to go far in Nascar I don't think thats the way to start it out. Hows people going to respect you if you don't respect other people. Wouldn't be a good ambassador to the sport!!

We have a race of racists in this country and no one dares call them out on it. You know damned well who I'm talking about. And who said the N word was used---no one so why bring it up. Maybe he talked about Arabs or Honkeys? As Supreme Court Justice Scalia said recently, "it will be almost impossible to recover from racial entitlements". i.e., people want, they want, they want and the government gives and gives and gives in exchange for votes: free apartments, free food pantrys, food stamps, free health care, free cell phones and service provider, EIC checks, assistance checks, free AFDC, free YMCA memberships, free city transpartation passes, and you name it, it's free for those to lazy or with no incentive to make it on their own and it's killing this country, and soon, free computers and computer service providers. Hey, how about the government paying for a free Prius for those on the dole. 10 of our 50 states have more people on Workers Comp or SS Disability than those working. Guess who they voted for? Not going to get better.

Romney told them he'd produce jobs. 51% said no, that they had it just fine. 51% will soon be 57% and then 60%, then 65%, then
